Please read these Terms of Use ("Terms") carefully before using the Updesh: Bhagavad Gita application and the Updesh website (together, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

2. Description of Service

Updesh provides access to the complete Bhagavad Gita on the web and through a mobile application for iOS, including Sanskrit, transliteration, English and Hindi translations, classical perspectives, and Sanskrit audio recitation. The Services also offer study tools such as bookmarks, notes, reading progress, guided paths, and, in the App, Home Screen widgets.

3. Free Access

The core content of the Services -- the complete text, translations, commentaries, and audio -- is provided free of charge. We may introduce optional premium features in the future, but core access to the Bhagavad Gita text and commentaries will remain free.

4. Content and Intellectual Property

4.1 Scripture Content

The Bhagavad Gita is an ancient sacred text in the public domain. The Sanskrit verses, transliterations, and classical commentaries included in the Services are sourced from publicly available translations and scholarly works.

4.2 Updesh Content

Original content created for the Services -- including but not limited to "Why This Matters" reflections, reading path curation, chapter introductions, UI design, illustrations, website code, and app code -- is the intellectual property of Updesh and is protected by applicable copyright laws.

4.3 Your Content

Any notes or bookmarks you create within the Services are yours. Website data stays in your browser; App data stays on your device and may sync through your private iCloud account. We do not access, use, or claim any rights to your personal content.

5. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the Services
  • Copy, modify, or distribute Updesh's original content without permission
  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to the Services' infrastructure

6. Availability and Updates

We strive to keep the Services available and up to date, but we do not guarantee uninterrupted access. We may update, modify, or discontinue features at any time. We will try to provide notice for significant changes.

7. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be error-free or uninterrupted, or that any content is completely accurate.

The spiritual and philosophical content in the Services is for educational and personal growth purposes. It is not a substitute for professional advice of any kind.

8. Limitation of Liability

To the fullest extent permitted by law, Updesh and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, regardless of the cause of action.

9. Third-Party Services

The App uses Apple's iCloud (CloudKit) for optional data sync. The Services use Cloudflare for audio content delivery, and the website uses Google Fonts for typeface delivery. Your use of these services is subject to their respective terms and privacy policies.

10. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Services after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions.
